Abstract
These Regulations, made under section 34 of the National Environmental Standards and Regulations Enforcement Agency (Establishment) Act, 2007, apply to new and used batteries, and provide for preventing and minimising pollution and waste emanating from batteries to the Nigerian environment. The Regulations concern: statutory requirements and submission to the National Environmental of the Environmental Impact Statement, the Environmental Audit Report, the Environmental Management Plan; drafting and preparation of an emergency response plan to combat pollution hazards in the event of accidental discharges; application of the polluter pays principle; best practices and waste minimisation; banned and restricted chemicals in batteries; pollution control organisational system; extended producer responsibility; effluent limitation standards; restriction on the release of toxic effluent into a water course or water body; sludge and wastewater disposal; emission standards; priority air pollutants; noise standards; sampling procedures and collection and analysis of samples; handling and disposal of used batteries; treatment and recycling measures; pollution abatement measures; general permits, monitoring and reporting; enforcement measures; offences and penalties.
