Abstract
This Act establishes the National Environmental Standards and Regulations Enforcement Agency as a body corporate and provides rules relative to the protection of the environment in Nigeria. The Agency shall be responsible for the effective enforcement of standards, Regulations and all national agreements and international agreements on environment to which Nigeria is a signatory. The Agency shall be governed by a Governing Council established by this Act. The Agency shall also, among other things: (a) enforce compliance with laws, guidelines, policies and standards on specific environmental matters; and (b) coordinate and liaise with stakeholders, within and outside Nigeria, on matters of environmental standards, regulations and enforcement.
As for specific environmental matters, the Agency shall: make Regulations setting specifications and standards to protect and enhance the quality of Nigeria's air resources; undertake to study data and recognize developments in force in other countries, regarding ozone protection; identify major noise sources, noise criteria and noise control technology and make Regulations on noise, emission, control and abatement; make Regulations for the protection of water quality; establish effluent limitations for new point sources which shall require application of the best control technology currently available and implementation of the best management practices; make Regulations for the purpose of protecting public health and promotion of sound environmental sanitation; and make Regulations, guidelines and standards for the protection and enhancement of the quality of land resources, natural watershed, coastal zone, dams and reservoirs including prevention of flood and erosion.
The Law also prohibits the discharge in harmful quantities of any hazardous substance into the air or upon the land and the waters of Nigeria or at the adjoining shorelines.
