Abstract
These Regulations, made under section 34 of the National Environmental Standards and Regulations Enforcement Agency (Establishment) Act, 2007, provide for the minimization of pollution from all operations and ancillary activities of the Food, Beverages and Tobacco Sector. The Regulations require companies to submit Environmental Impact Statement (EIS) for new industries and major developmental projects before commencement of operations. The Regulations also task companies to reduce the amount of packaging material and implement the reuse, recovery and recycling of packaging materials. Furthermore, companies are tasked to install anti-pollution equipment to detoxify effluent and emissions emanating from their operations. The Regulations provides for the application of the Polluter-pays principle. Among others, the Regulations provide for the management of oil stations and fuel dump sites, effluent limitation and treatment, sewage disposal, emissions and noise.
