Abstract
These Regulations, made under provisions of section 34 of the National Environmental Standards and Regulations Enforcement Agency (Establishment) Act, no. 25 of 2007, provide for specifying the guidelines and direction for the use, handling, record keeping, labelling, and safe disposal of Ozone Depleting Substances (ODS), Hydrofluorocarbons (HFCs), and Refrigeration and Air-conditioning (RAC), and apply to operators and handlers of these hazardous substances. Matters covered by the Regulations concern: powers and responsibilities of competent authorities and agencies, including: specifying the annual maximum quantity of ODS and HFCs to be imported into the country, in compliance with the provisions of the International Conventions; monitoring and facilitating ODS phase out activities in the country; best practices in emission control; extended producer responsibility for manufacturers and importers of hazardous substances; environmental management system; polluter pays principle; permit conditions and fees; prohibitions on importation of hazardous substances; offences and penalties provisions.
