Abstract
This Act concerns matters related to registration of trade marks in Nigeria. The Act covers the following matters: registrar of trade marks; registration in respect of particular goods; effect of non-registration; rights given by registration in various part of the register; saving provisions for vested rights; use of name, address or description of goods; validity of registration; Distinctiveness needed for registration in Part A of the register, including geographical characteristic of the good; capability of distinguishing trade mark needed for registration in Part B; deceptive or scandalous matters not registrable; chemical or hazardous substances not to be registered; procedural matters concerning registration and its duration; removal from register of a trade mark on ground of non-use; registration of well-known invented words; use of trade mark in relation to goods for export; classification of goods; international arrangements for protection for any trade mark; legal proceedings and appeals; falsely representing trade mark as registered.
