Decree No. 192 of 2002 relative to entry into force of article 38, comma 3, of the Soil Protection Act and indication of circumstances and measures in the sense of that article (Decree Location Specific Conditions Soil Restructuring).

This Decree provides criteria for judging if a project for the restructuring of polluted soil must be carried out completely by its owner/polluter, or a limited restructuring which allows isolation and control of the pollution suffices. The criteria balance costs of restructuring against the need to restructure the soil completely for the safeguarding of the health of men, animals, and plants. Some rules for limited restructuring are provided. The balancing of criteria does not apply to pollution soil under or near surface waters. (3 articles)
