Abstract
The present Regulation lays down the legal framework for the approval, marketing, and use of plant protection products, active substances including microorganisms, and other ingredients in plant protection products. The Regulation implements Regulation (EC) No. 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC; and Commission Implementing Regulation (EU) No. 540/2011 implementing Regulation (EC) No. 1107/2009 of the European Parliament and of the Council as regards the list of approved active substances. It also implements EU Regulations that reject the approval for active substances (Section 5) and EU Regulations that implement Regulation (EC) No. 1107/2009 (Section 6). For organisms used in the biological control of plant pests, as defined in 27, first paragraph, only 10, 12, 14, and 25 to 33 apply. Chapter III of the Regulation, concerning authorization certificates, applies to both plant protection products and certain rodenticides approved under the regulation of April 18, 2017, no. 480 on biocides.
The Regulation requires Norwegian authorization for purchasing and using professional pesticides in Norway, as well as for providing professional guidance on chemical crop protection. Special requirements are included to obtain authorization to purchase and use high-hazard classified fumigation products for indoor or outdoor use. All retailers, importers, and manufacturers of plant protection products, except retailers dealing exclusively in ready-to-use hobby preparations, must register with the Norwegian Food Safety Authority (Mattilsynet) before they distribute, import, or produce plant protection products. Importers and manufacturers are required to submit a report to the Norwegian Food Safety Authority detailing the sales of plant protection products.
The professional use of plant protection products must be carried out using spreading equipment that meets the requirements specified in Annex 1 of this Regulation. Special requirements are included for areal application. The Regulation establishes an obligation to reduce the risk of water pollution, and prohibits the application of pesticides in certain areas, including in buffer zones within and around cultivated land, in children's play areas, and plantations bordering public roads or private gardens, as well as in parks or other publicly accessible areas in the case of particularly hazardous pesticides. Users of professional preparations must familiarize themselves with and apply the general principles of integrated pest management as outlined in Annex 2 of this Regulation.
The Regulation contains 33 Sections organized in the following chapters: I. Introductory Provisions; II. Implementation of Regulations; III. Authorization Certificates; IV. Chapter IV. Requirements for Distributors, Importers, and Manufacturers; V. Functional Testing of Application Equipment; VI. Special Requirements for Aerial Application; VII. General Requirements for Application; VIII. Storage and Residues of Plant Protection Products; IX. Integrated Pest Management; X. Final Provisions. It also contains Norwegian translations of the EU Regulations that are implemented.
