Abstract
This Act provides for land use in Nepal and aims to regulate the classification, proper use, and effective management of land for optimal and sustainable benefits. The Act establishes guidelines for the implementation of land use programs, including the classification of land into different categories based on its characteristics and suitability. It mandates the preparation of land use maps for each local level, which must be updated regularly to reflect changes and ensure proper land management.
The Act imposes restrictions on land use change and land classified for a specific purpose cannot be used for another purpose without approval. Any change in land use must be reported to the local land use council, which can request approval from the regional council. The federal council can approve changes based on recommendations from regional councils. The government has the power to change land use for significant projects, natural resource sites, or areas of national importance. The Act provides for establishing committee to monitor and implement land use plans, including taking action against unauthorized land use. Fragmentation of lands is restricted. The Act contains provisions for the establishment of land use banks to maximize land productivity. Optimal land use is encouraged through various programs and periodic reviews of land use plans. The penalties for violations of land use regulations are laid down and include fines and corrective actions.
