Abstract
This Act aims to prevent the introduction and spread of pests when importing and exporting plants and plant products and to promote trade in plants and plant products by adopting appropriate measures for their effective control.
The Act provides for the establishment of a Plant Quarantine Committee to advise the Government on policies regarding quarantine of plants and plant products. The Act defines the composition of the Committee and specifies its functions, powers and duties which include: to advise the Government on the formulation of a national policy on plant quarantine; review import, export and inspection fees; prepare a list of controlled pests; and approve standards on sanitation of plants or plant products.
The Government of Nepal shall have the power to designate a National Plant Protection Organization which shall be responsible for preparing standards for the Committee on the sanitation of plants or plant products to be imported or exported, identifying endangered areas and protect plants and plant products in such areas through quarantine process, identifying pest free areas and areas of low pest prevalence and making declaration and surveillance of such areas, etc.
The Act sets out procedures and requirements for obtaining an import permit and phytosanitary certificates for the import or transit of all shipments of plants and plant products.
The Act further provides for: designation of inspectors and their power and duties; powers of the Organization to make pest risk analysis and declare quarantine pest affected areas; offences and penalties; etc.
