Abstract
These Regulations are made in exercise of powers provided under section 59 of the Water Supply and Sanitation Act, 2022 (Act). Chapter 1 of the Regulations contain the short title and definitions. Chapter 2 lays down the responsibilities and obligations of the government of Nepal, provincial governments and local level for the purposes of section 8 of the Act. This includes undertaking drinking water and sanitation projects of national pride, public-private partnership projects, reservoir water supply projects, sewage collection systems and treatment plans, solid and liquid waste management systems.
Chapter 3 provides for the procedure to obtain license for providing water supply and sanitation services as mentioned in section 10 of the Act, survey license under section 12 of the Act, or a separate sewerage license. The process for purchase and sale of bulk water or export of bottled or bulk water under sections 23 or 50 of the Act is laid down. The provisions relating to fees, license conditions and duration are also given. Chapter 4 contains provisions in respect of operation and management of water and sanitations services. The procedure for registration of water users associations is provided. The responsibilities of service providers is laid down and includes operation, management, repair, protection and maintenance of water and sanitation systems. The provisions for construction of structures or laying down pipelines are made. Chapter 5 lays down the basis for providing water and sanitation services and also the priorities for water service usage.
Chapter 6 makes provisions relating to the Water Supply and Sanitation Service Tariff Fixation Commission and the basis for determination of tariffs and service charges. Chapter 7 contains provisions in respect of application for water connection and installation of water meters. Chapter 8 provides for procedure to obtain sewerage services and states that the service provider must comply with the norms prescribed. Chapter 9 lays down provisions in respect of the quality and standards for supply of drinking water. The treatment methods that can be undertaken are listed and establishment of laboratory for testing of samples is provided for. Chapter 10 makes provisions for monitoring of quality and standards and lays down the duties of inspectors. Chapter 11 contains the duties and powers of the coordinating committee, rainwater harvesting and recharge of ground water requirement and responsibility of various authorities for implementation.
