Abstract
This Act provides for the management and operation of water supply and sanitation services in Nepal. It consists of ten chapters: 1. Preliminary; 2. Regarding source and rights of water supply and sanitation; 3. Duties and responsibilities of water supply and sanitation; 4. Provisions regarding license; 5. Regarding the Operation of water supply and sanitation service; 6. Regarding tariffs and service charges; 7. Regarding quality and standard; 8. Regarding monitoring and surveillance of services; 9. Regarding offence and punishment; and 10. Miscellaneous.
Chapter 1 contains the short title and definitions. Chapter 2 provides for right to water supply and sanitation including easy access to clean water supply. The rights to water sources shall vest with the government of Nepal. It also makes provisions for conservation of water sources and works to be done in that regard by the government of Nepal in coordination with the provincial and local governments. The duties of citizens is laid down and operation and management of water supply and sanitation is provided. Chapter 3 lays down the responsibilities and obligations for providing water supply services, sanitation services and project license, construction, operation and management at various levels of government. Chapter 4 requires a license to be obtained for providing water supply and sanitation services and lays down the procedure to obtain the same.
Chapter 5 contains provisions in respect of operations and services for water supply and sanitation by licensed institutions. It also provides for services through contract, water quality, laying of pipes, termination of services, and security of water and sanitation systems. Chapter 6 provides for tariffs and service charges. It establishes a Water supply and Sanitation Service Tariff Fixation Commission to determine the tariffs to be paid by the users for water supply and sanitation services. Chapter 7 requires the government of Nepal to prescribe the quality and standards of water supply and sanitation services and to establish and operate a laboratory for testing the quality of water supply and waste-water.
Chapter 8 contains provisions relating to monitoring and surveillance of services through inspectors. Chapter 9 lays down the offences and punishment. Chapter 10 provides for programs and campaigns to be conducted in relation to health and sanitation. It allows export of bottled or bulk water. The government of Nepal must frame standards in respect of use of underground water and water quality of rivers and lakes. A coordinating committee for inter-level coordination is formed.
