Abstract
The Act is divided into five Parts and twenty-six sections: Analysis; territorial sea (I); Exclusive Economic Zone of Niue (II); Fishing by Foreign Vessels (III); Miscellaneous Provisions (IV).
Part I defines the territorial sea and Internal Waters of Niue. Part II provides for the establishment of an Exclusive Economic Zone and empowers the cabinet to determine, from time to time, the total allowable catch (sect. 11). Where any part of a median line between Niue and another country is less than 200 nautical miles form the nearest point on the baseline of the Territorial Sea of Niue, that part of the median line shall be an outer limit of the Zone (sect. 10, Comma (2). Part III makes provision for licenses for foreign vessels (sects. 12-15), fees (sect. 16) and empowers the Cabinet to enter into international access agreements. Other provisions of Part III deal with offences and penalties (sect. 17). Part IV provides for enforcement (sects. 18-23), fishing for non-commercial purposes (sect. 24) and regulation making powers (sect. 25).

An Act to make provision with respect to the Territorial Sea of Niue and to establish an Exclusive Economic Zone of Niue adjacent to the Territorial sea, and in exercise of the sovereign rights of Niue to make provision for the exploration and exploitation, and conservation and management, of the resources of the zone; and for matters connected with those purposes.
Entry into force notes
This Act shall be deemed to have come into force on 1 April 1978 (art. 1, para. 1).
