Abstract
An Act to establish a territorial sea and an EEZ of Niue and to regulate fisheries and the conservations of living resources in fishery waters of Niue.
The Act is divided into twelve Parts and sixty-two sections: Territorial Sea (I); Exclusive Economic Zone of Niue (II); Application (III); Fisheries Management and development (IV); Unautorised fishing and prohibited fishing methods (V); Access Agreement (VI); Licensing (VII); authorized officers and observers (VIII); Sale, release and forfeiture of retained property (IX); General penalty and liability (X); Regulations (XI); General (XII).
Provisions of Part I establish a territorial sea of Niue of twelve nautical miles, define internal waters, and the baselines of the territorial sea. Provisions of Part II establish an EEZ of Niue of two hundred nautical miles. For reasons of conservation or management of fish resources, the Cabinet may declare a fishery to be a designated fishery under section 12. Management and development plans shall be prepared for such designated areas (sects. 13 to 16). The Minister of Agriculture, Forestry and Fisheries may conclude access agreements on behalf of Niue with one or more other countries, taking into account requirements with respect to the contents of an agreement laid down in section 22. Licences for fishing crafts shall be issued by the Minister in accordance with sections 27 to 35. The Director may designate one or more persons to be observers on board of fishing crafts (sect. 43).

An Act to make provision with respect to the Territorial Sea of Niue and to establish an Exclusive Economic Zone of Niue adjacent to the Territorial sea, and in exercise of the sovereign rights of Niue to make provision for the exploration and exploitation, and conservation and management, of the resources of the zone; and for related matters.
