Abstract
The purpose of this order is to prevent, and limit the risk of, an outbreak, or the spread, of COVID-19 by a) restricting which ships may arrive in New Zealand; and b) continuing isolation and quarantine requirements for people who arrive in New Zealand by sea; and c) enabling the safe transfer of crew.
Part 2 distinguishes among New Zealand ships, New Zealand warships and Foreign ships (clause 9 establishes that Foreign ships are not generally permitted to arrive in New Zealand). The Part then continues providing a list of exceptions to clause 9, these are for instance: a cargo ship that is arriving in New Zealand for the purpose of loading or unloading cargo, a fishing ship (unloading its catch; or reprovisioning or refuelling, or both; or embarking or disembarking its crew under Part 4); a foreign State ship that has been granted diplomatic clearance by the Ministry of Foreign Affairs and Trade. Exemptions are also recognised for ships that have received a permit buy the Director-General under clause 11 for one of the matters listed under clause 12. Exemptions also subsist for ships in distress. Part 2 also establishes requirements to give notice of arrival.
Part 3 concerns Isolation and Quarantine and lays down requirements to be isolated or quarantined and exceptions for persons disembarking ships, obligation to undergo testing and medical examination also for crew leaving ship to depart New Zealand by air. A section is dedicated to ships in isolation and quarantine; this clause applies if a person remains in isolation or quarantine on board a ship.
Part 4 concerns exemptions for arriving and departing crew Part 5 lists other exemptions.
