Abstract
The purpose of the Act is to provide better protection of human rights in New Zealand in general accordance with United Nations Covenants or Conventions on Human Rights. Part 1 disciplines functions, activities, membership of the Human Rights Commission and of the commissioners, general manager and director; the Commission shall be the same body as the Human Rights Commission established under section 4 of the Human Rights Commission Act 1977. Part 1A applies only in relation to an act or omission of a person or body referred to in section 3 of the New Zealand Bill of Rights Act 1990, namely the legislative, executive, or judicial branch of the Government of New Zealand; or a person or body in the performance of any public function, power, or duty conferred or imposed on that person or body by or pursuant to law, when the act or omission is inconsistent with the right to freedom from discrimination affirmed by section 19 of the New Zealand Bill of Rights Act 1990.
Part 2 disciplines unlawful discrimination and provides a list of prohibited grounds of discrimination (such as sex, pregnancy, childbirth, marital status, ethnic, age, employment among others) and exceptions. It also considers discrimination by industrial and professional associations, qualifying bodies, and vocational training bodies, discrimination in provision of goods and services, discrimination in provision of land, and other forms of discrimination such as victimization of whistleblower or person making use of rights prohibited, Part 3 concerns resolution of disputes about compliance with Part 1A and Part 2, and establishes how complaints received to be treated, what actions to be taken, information provided to the parties, evidence gathering, confidentiality, proceedings, remedies, etc.
Part 4 regulates Human Rights Review Tribunal with functions to consider and adjudicate upon proceedings brought pursuant to sections 92B, 92E, 95, and 97 and others. Part 5 concerns evidence and grants protection and privilege of witnesses.
