Abstract
This Royal Decree consists of 2 Chapters divided into 24 articles and issues the Law on the protection of new plant varieties. The provisions of this Law are applicable to the propagation types and components for the production of plants. The Minister of Agriculture and Fisheries shall decide the fees for the applications, certificates and licences related to plants breeding. The Law defines the breeder’s right, their assignment and duration, the application and the registration procedures for the breeder’s right holder.
More in detail: Chapter I deals with the following matters: (a) terms and definitions; (b) application of the Law to all plant multiplication and reproduction elements; (b) the issuance of a resolution by the Minister of Agriculture and Fish Resources, cooperating with the Ministry of Finance, to define application deposit fees, plant breed certificates and licences issued by the Competent Authority; (c) settlement of disputes arising from the application of this Law and the Implementing Regulation; and, (d) offences and penalties. Chapter II contains articles dealing with the following: (a) breeders rights; (b) plant multiplication and reproduction elements to be protected, according to this Law, shall be new, distinguished and homogenised; (c) the period of protection of breeders rights is to be 20 years; (d) the breeders' rights shall include commercial exploitation of the plant multiplication and reproduction elements, transfer of exploitation rights, prevention to other persons to exploit this right and compensation in case of offences of this right; (e) registration of plant breeds which shall be presented to the competent Authority; (f) requirements and cases of the transfer of breeders right's, etc.
