Abstract
The Public-Private Partnership (PPP) Code covers all contractual arrangements between government agencies and private entities for financing, designing, constructing, operating, and maintaining infrastructure or development projects traditionally handled by the public sector, with shared risks between both parties. PPP projects may be funded by government appropriations, Official Development Assistance (ODA), or blended financing. The Code also includes joint ventures, toll operation agreements, and lease agreements for government-owned facilities. However, it excludes projects under the Government Procurement Reform Act and certain commercial or service contracts, which are governed by other laws. The text refers to Green Financing as investments that support environmental benefits, green growth, low-carbon initiatives, and sustainable development. The text further provides for identification and development of PPP projects, approval of projects, bids and award committees, protest mechanism, project supervision and monitoring, and creation of risk management fund. The Code consists of 38 Articles.
