Abstract
This Act provides for regulation and management of fisheries and aquaculture in the Khyber Pakhtunkhwa province of Pakistan. The Act contains eight chapters: I. Preliminary; II. Directorate General of Fisheries; III. Fisheries Park, Sanctuaries and Power to Lease; IV. License, Permit and Special Permit; V. Offences, Arrest and Seizure; VI. Penalties and Punishments; VII. Trial of Fisheries Offences; and VIII. Miscellaneous.
Chapter I consists of short title, extent, commencement and definitions. Chapter II establishes the Directorate General of Fisheries to deal with all matters provided in this Act. It provides for the appointment of Inspectors of Fisheries. Chapter III provides for establishment of Fisheries Parks for recreation, education and research activities, and eco-tourism. It also empowers the government to declare any public water to be a sanctuary, in respect of such species of fish as mentioned in the First Schedule. The Director general may lease out the fishing right in public water and allow to install fish cages or other aquaculture related technologies.
Chapter IV contains provisions relating to licenses and permits in respect of activities in Chapter III. Chapter V provides for offences, arrest and seizure of persons and their catch, fishing gear etc. Chapter VI contains penalties and punishment for offences committed under the Act. Chapter VII provides for trial of fisheries related offences. Chapter VIII prohibits interference in duty by officers under the Act and allows the Director General to amend the First Schedule as required.
