Abstract
The Act consist of 93 sections and is divided into 11 Parts: Preliminary (I); Of The Construction and Maintenance of Canals (II); Of Water-Courses (III); Of The Supply of Water (IV); Of the Award of Compensation (V); Of Water-Rates (VI); Of Obtaining Labour For Canals on Emergencies (VII); Of Penalties (VIII); Miscellaneous (IX); Of Second-Class Irrigation Works (X); Special provisions for Certain Lands Irrigable by the Lloyd Barrage Canals (XI).
The Act makes provision for the construction and maintenance of canals, establishing also the powers of the Canal-officer appointed by the Provincial Government. The construction of new water-courses by private arrangement is subject to the permission of the Canal-officer and to the provisions made by the present Act as regards the obligations and rights of the owner (e.g. maintenance of water courses, use of land acquired for water-course, settlement of disputes). The water shall be supplied upon application to the Canal-officer, and the supply shall not be stopped unless necessary for the execution of waterworks, for the prevention of waste of water, for rotational supply, etc. Furthermore, the Act establish the procedure to be followed for the award of a compensation in cases of ascertainable substantial damage. Water rates shall be established for the supply of water according to the provisions of Part VI. Further provisions concern the construction of second class irrigation works. The procedure includes the notification by the Provincial Government and the publication of a proclamation by the officer appointed by the Government, specifying the source of supply and fixing a period for the filing of complaints. According to article 75, a second-class irrigation work shall be deemed to be a canal within the meaning of the Act and, therefore, the sections listed therein shall be applicable. As far as lands irrigable by the Lloyd barrage canals are concerned, special provisions are made with respect to the power of the Canal-officer to change the source of water-supply, the construction of new waterworks, the cost and the distribution of cost for said construction, and the revision of the sum to be paid by the holder of the land on account of the cost of constructing or re-constructing of water courses.
