Decree-Law No. 294/94 establishing the legal regime for the concession of operation and management of multi-municipal urban solid waste treatment systems.

This Decree-Law establishes the legal framework for the concession of the operation and management of multi-municipal urban solid waste treatment systems. The operation and management covers the design, construction, acquisition, extension, repair, renovation, maintenance of works and equipment and their respective improvement. The operation and management of multi-municipal systems for the treatment of solid urban waste generated in the areas of the user municipalities constitutes a public service to be exercised on an exclusive basis. The fundamental objective of the operation and management of multi-municipal systems for the treatment of solid urban waste is to contribute to public sanitation and the well-being of the population by ensuring, in particular: a) Appropriate treatment of solid urban waste, under the terms of the concession contract, to the real needs of the user municipalities in quantitative and qualitative terms and in accordance with the applicable national and Community standards; b) Promoting actions necessary for a correct urban solid waste management policy, particularly with regard to waste reduction and disposal; c) Cost control through the rationalization and efficiency of the means used in its various phases.
