Abstract
This Order, consisting of 8 articles and two Annexes, establishes criteria for assigning the End of Waste Statute (RES) to rubber material derived from used tires. This Order applies to the definitions established in article 3 of Decree-Law No. 178/2006 of 5 September and in article 2 of Decree-Law No. 111/2001 of 6 April, respectively. Criteria applicable to rubber material derived from used tires should meet the following requirements. The rubber material benefits from the end of waste status when these conditions are fulfilled: a) the material resulting from the recovery operation fulfills the criteria set out in point 1 of Annex I; b) waste used as raw material in the recovery operation fulfills the criteria set out in point 2 of Annex I; c) waste used as raw material in the recovery operation is treated in advance in accordance with the criteria set out in point 3 of Annex I; d) producers satisfy the requirements laid down in Articles 4 to 7; e) Rubber material derived from used tires is not intended for specific applications. For each rubber material derived from used tires, the producer or person responsible for the introduction into national territory must issue a declaration of conformity in accordance with the model in Annex II to this Order. The declaration of conformity must accompany the transport of rubber materials.
