Abstract
This Order establishes the minimum conservation reference sizes for species, concerning the conservation of fisheries resources and the protection of marine ecosystems through technical measures. It applies for species for which minimum sizes are not set by EU legislation, namely by EU Regulation No. 2019/1241, of the Parliament and the Council of 20 June 2019, on the conservation of fisheries resources and the protection of marine ecosystems. The minimum conservation reference sizes are set out in Annex I applying to activities carried out in the waters referred to in paragraph 1 of article 2 of Decree-Law No. 73/2020 of September 23. Captured species whose sizes are smaller than the minimum dimensions set in national legislation or in EU Council Regulation No. 2019/1241 of 20 June 2019 must be immediately released in sea and may not be kept on board, transshipped, landed, transported, stored, displayed, offered for sale or sold. The measurement of the size of fish, crustaceans and molluscs is carried out in accordance with Annex IV of EU Council Regulation No. 2019/1241 of 20 June 2019.
