Abstract
This Regional Legislative Decree approves the amendments in the Regional Water Programme of the Azores (PRA), which takes the form of a sectorial programme, within the scope of the basic law on the public policy of soils, territorial organization and urbanism (LBGPPSOTU), approved by Law No. 31/2014 of 30 May, in conjunction with the legal regime of the territorial management instruments of the Azores (RJIGT.A), approved by Regional Legislative Decree No. 35/2012/A of 16 August, whose Summary Technical Report is attached. The relations between the National Water Plan (PNA) and the alteration of the Regional Water Program must be governed by the principle of articulation, also in accordance with article 25 of the RJIGT.A, given that they constitute programmatic instruments of the same nature, which they establish the main guidelines to be integrated by the development instruments. This means that they cannot contain contradictory provisions, and must reflect a commitment to integration and compatibility of the respective options.
Thus, due compatibility with the three fundamental objectives that the PNA defined for water management is ensured, namely the protection and requalification of the state of aquatic ecosystems and terrestrial ecosystems, as well as the wetlands that depend on them, with regard to to their water needs, the promotion of sustainable, balanced and equitable use of good quality water, with the allocation to the various types of uses, taking into account its economic value, based on a long-term protection of available water resources, and increasing resilience to the effects of floods and droughts and other extreme weather events resulting from climate change. The territorial scope of the amendment to the PRA comprises all the hydrographic basins of the 9 islands of the Azores archipelago, including the respective groundwater and adjacent coastal waters, covering the 19 municipalities of the RAA.
