Abstract
This Regulation consisting of 19 articles aims at regulating Resolution No.24 of 2005 on Agricultural Quarantine. It states that a Quarantine Center shall be established within every customs office, where shipments may enter or exit. The Minister in the quarantine centers may establish specific units. The Minister will decree a zone of quarantine in case of suspect of the scourge of agricultural land, or in storage areas (sites) or anywhere else, and the competent administration shall take all necessary actions. Inspections may require: take samples of the shipment (consignment) and send it to the competent laboratory to be analyzed; issue a release certificate after making sure the shipments are free of pests, diseases and harmful substances or after treatment of non-quarantine pests; notify the importer in writing to re-export the consignment infected, or destroy it on the Minister’s Resolution.
It is authorized the introduction of the consignment of agricultural material if accompanied by a phytosanitary certificate issued by the competent authorities in the exporting country. Article 10 specifies consignments banned to be entered. Article 11 indicates conditions to enter plants and plant products associated with passengers. Article 12 deals with exemptions from the requirement to obtain an import license. Article 13 provides control measures. The owner or importer of any shipment crossing the State must notify the competent department in writing well in advance of their arrival at the port of entry, and an inspector can control any shipment entering the territory of the State, whether by land, sea or air. Article 16 states that export of a consignment is possible only after obtaining permission from the competent management, license shall be valid from the date of issuance until the last day of December of the same year. Importer or exporter bears all the costs and responsibilities of the inspection, including unloading, loading and transportation costs to the costs of entry and re-export or processing or destruction.
