Abstract
This Decisions sets out terms to be considered and respected in relation to the procedure for carrying out environmental assessments necessary for plans and programmes that have an environmental impact on the territory of Romania.
Objective of this Decision is to ensure a high level of environmental protection and to contribute to the integration of environmental considerations in the preparation and adoption of certain plans and programmes, with a view to promoting sustainable development by conducting an environmental assessment, as these plans and programmes that may have significant effects on the environment. This Decision establishes the procedure for carrying out the environmental assessment, applied for the purpose of issuing the environmental opinion necessary for the adoption of plans and programs that may have significant effects on the environment, defining the role of the competent authority for environmental protection, among public participation. The environmental assessment is here defined as integral part of the procedure for adopting all related plans and programmes. The environmental assessment shall be carried out during the preparation of above mentioned plan and/or programmes and shall be completed before its adoption or referral to the legislative procedure. This procedure is performed in stages, as follows: a) the stage of framing the plan or programme in the environmental assessment procedure; b) the stage of finalizing the draft of such plan and making of environmental report; c) the stage of analyzing the quality of the environmental report.

Entry into force notes
This Decision enters into force 120 days after its publication in the Official Gazette of Romania, except for the provisions of article 39 (paragraphs 2 and 3) which shall enter into force on the date of Romanian accession to the European Union.
