Emergency Ordinance No. 44 regarding the conduct of economic activities by authorized natural persons, individual businesses and family businesses.

This Emergency Ordinance regulates access to economic activity, the procedure for registration in the trade register and authorization of operation and the legal regime of natural persons authorized to carry out economic activities, as well as individual and family businesses. It does not apply to liberal professions, as well as to those economic activities whose development is organized and regulated by special laws. Family enterprise shall be intended the economic enterprise, without legal personality, organized by an entrepreneur natural person together with his family. Any economic activity carried out permanently, occasionally or temporarily in Romania by authorized natural persons, individual businesses and family businesses must be registered and authorized, under the conditions of this emergency ordinance. Any member of the family business can request registration in the trade register and authorization of operation. The family enterprise is established through a constitution agreement, concluded by the family members in written form, as a condition of validity.
