Emergency Ordinance No. 78 regarding the waste regime.

The scope of this Emergency Ordinance is the regulation of waste management activities under conditions of protection of the health of the population and the environment. Waste management is based on the following general principles: (a) the principle of using only waste management processes and methods that do not endanger the health of the population and the environment; (b) the "polluter pays" principle; (c) the principle of responsibility of the manufacturer; and (d) the principle of using the best available techniques, without incurring excessive costs. The competent authorities establish the appropriate measures for: 1. preventing the generation of waste and its harmful effects, through: (a) the development of clean and economical technologies in the use of natural resources; (b) the technical development and marketing of products designed in such a way that, through their manufacturing characteristics, through their use and through their disposal after use, they should not contribute or contribute as little as possible to increasing the risk of pollution and the degree of harmfulness of the waste; (c) the development of appropriate techniques for the elimination or neutralization of hazardous substances contained in the waste intended for recovery; 2. the recovery of waste through recycling, reuse or through any other process aimed at obtaining secondary raw materials or the use of certain categories of waste as a source of energy. Environmental contracts and authorizations for carrying out waste recovery and waste disposal activities are issued for a maximum period of 5 years. The environmental contract and/or authorization must contain: (a) the types and quantities of waste; (b) the technical requirements; (c) the safety measures that must be taken; (d) the waste recovery or disposal sites; and (e) the methods of waste treatment, recovery and disposal.
