Emergency Ordinance No. 97 validating the Regulation on food production, circulation and marketing.

This Emergency Ordinance establishes the unitary legal framework related to the production, packaging, storage, transport and marketing of food, the responsibilities of food producers and traders, the organization of official food control and sanctions in order to protect the quality of food. The application of the provisions protects consumers from incorrect practices in the manufacturing, storage and sale of food and ensures conditions for their correct and complete information, in accordance with legal regulations regarding consumer protection. The provisions do not apply to food produced in individual households for their own consumption, nor to foodstuffs that are in transit or that are temporarily stored, as goods of the transiting country, if they do not represent a danger to human health or to the environment. When manufacturing food, only additives and packaging materials or any other materials that come into contact with food shall be used only those, approved by the Ministry of Health and Family together with the Ministry of Agriculture, Food and Forestry, according to the legal regulations in force. The manufacture, storage and transport of food shall be done in compliance with the technological, hygienic-sanitary and veterinary sanitary norms, which ensure the fulfillment of public health, food hygiene and food quality requirements.
