Abstract
The purpose of this Law is a better functioning of the market and ensuring a high level of protection of consumers, by regulating commercial practices that may affect the economic interests of consumers. Product shall be intended any goods or services, including real estate, entailing rights and obligations. This Law applies to unfair practices of traders in the relationship with consumers, during and after a commercial transaction relating to a product. A commercial practice is incorrect if: (a) it is contrary to the requirements of professional diligence; and (b) b) deforms or is likely to essentially deform the economic behavior of the average consumer reached or addressed or of the average member of a group, when a commercial practice is addressed to a specific group of consumers. Commercial practices likely to essentially distort the economic behavior of a certain vulnerable group of consumers, clearly identifiable, must be evaluated from the perspective of the average member of the group. A commercial practice is considered to be a misleading action if it contains false information or, in any situation, including the general presentation, misleads or is likely to mislead the average consumer, so that, in both assumptions either cause or are likely to cause the consumer to make a transaction decision that he would not otherwise have made. The National Authority for Consumer Protection can order measures according to this Law, by order issued by the head of the National Authority for Consumer Protection or by decision issued by the heads of units with legal personality subordinate to the National Authority for Consumer Protection.
