Government Ordinance No. 4 regarding the manufacture, marketing and use of phytosanitary products to combat diseases, pests and weeds in agriculture and forestry.

To combat diseases, pests and weeds in agriculture and forestry, only phytosanitary products approved by the Interministerial Commission are manufactured, marketed and used on the territory of Romania prior approval of phytosanitary products, according to the provisions of this Ordinance. The products approved for use in Romania are contained in the Codex of phytosanitary products, which is drawn up, periodically updated and published in the Official Monitor of Romania, under the care of the Interministerial Approval Commission. Approved phytosanitary products shall be covered by certificate. The approval certificate includes: the commercial name of the product, the manufacturer, the active substance, the content of the active substance and its main characteristics, the spectrum of action, the fields of use, the doses of use, the toxicity group, as well as any other provisions that determine a responsible conduct on the part of manufacturers, traders and users. The period for which the approval certificate is issued is maximum of 5 years, after which the owner is obliged to request an extension of its validity. Failure to request the extension of validity, within 3 months of its expiration, results in the legal cancellation of the approval certificate and the removal of the products from the Codex of phytosanitary products, approved for use in Romania. The manufacture in Romania of some phytosanitary products that are not approved for use on the national territory, being produced for export, can only be made on the basis of a special authorization issued by the Ministry of Health and the Ministry of Water, Forests and Environmental Protection. Import of phytosanitary products is done only under a licensing regime and is allowed for legal entities from the public or private sector, constituted and authorized in accordance with the legal provisions in force.
