Governmental Ordinance No. 41 on marketing of plant protection products, as well as modification and abrogation of some normative acts in the field of phytosanitary.

This Governmental Ordinance establishes that commercialization on the territory of Romania of plant protection products, manufactured in the country or imported or from EU member states, can only be done by the persons listed in art. 3, on the basis of a registration certificate issued by the competent phytosanitary unit, according to the model contained in the Annex 1. The period for which the registration certificate is issued is a maximum of 5 years, with an annual renewal. Failure to apply for the annual renewal, within one month of its expiry, results in the annulment of the registration certificate and the prohibition of the marketing of plant protection products. Plant protection products can only be sold within phytopharmaceutical units, respectively phytopharmaceuticals and phytopharmaceutical warehouses, which consist of specially arranged spaces, according to the organizational and operating conditions contained in Annex 2. It is prohibited to sell plant protection products in phytopharmaceutical units that are not authorized for operation in Romania. Natural persons or family associations can register only for the retail trade of plant protection products classified as harmful (Xn), irritant (Xi) or those without hazardousness classification. For the registration regarding the activity of retail trade with plant protection products, applicants will submit the following documents to the competent territorial phytosanitary unit: A. economic operators, legal entities: (a) application for obtaining the registration certificate for the sale of plant protection products, according to the model from contained in the Annex 4; (b) copies of the ascertaining certificate, the registration certificate or the certificate of registration regarding the simplification of the formalities for the registration in the trade register of natural persons, family associations and legal persons, their fiscal registration, as well as for the authorization of the operation of legal persons, with subsequent amendments and additions; (c) copy of the professional attestation certificate for marketing activities of plant protection products for employees; B. natural persons or family associations: (a) request for obtaining the registration certificate for the marketing of plant protection products, according to the model contained in Annex 4; (b) copy of the authorization issued by the competent authorities; (c) copies of the ascertaining certificate, the registration certificate or the certificate of registration; and (d) copy of the professional attestation certificate for plant protection products commercialization activities. For the commercialization of plant protection products can be registered by natural or legal persons from other member states of the European Union who are certified by the competent authorities of the respective states.
