Abstract
The scope of this Law is to create the legal framework for the development and implementation of the national energy efficiency policy in order to achieve the national objective of increasing energy efficiency. Energy efficiency shall be intended the ratio between the value of the performance result obtained, related to the resulting services, goods or energy, and the value of the energy used for this purpose. Energy efficiency policy measures apply to the whole chain: primary resources, production, distribution, supply, transport and final consumption. The national energy efficiency policy is an integral part of the state's energy policy and aims at: (a) removing barriers to the promotion of energy efficiency; (b) promoting energy efficiency mechanisms and financial instruments for energy saving; (c) educating and raising the awareness of final consumers on the importance and benefits of applying energy efficiency improvement measures; (d) cooperation between final consumers, producers, suppliers, energy distributors and public bodies in order to achieve the objectives set by the national energy efficiency policy; and (e) promoting fundamental and applied research in the field of energy efficiency. National energy efficiency policy defines objectives related to improvement of energy efficiency and indicative energy saving targets, in all sectors of the national economy, with special reference to: (a) introduction of energy efficiency technologies, modern measurement and control systems, as well as energy management systems, for monitoring, continuous assessment of energy efficiency and forecasting of energy consumption; (b) promoting the use of energy-efficient equipment and appliances to final consumers, as well as renewable energy sources; (c) reducing the environmental impact of industrial activities and the production, transport, distribution and consumption of all forms of energy; (d) application of modern energy management principles; (e) granting financial and fiscal incentives, in accordance with the law; and (f) market development for energy services. National Energy Regulatory Authority (ANRE) shall ensure maintenance of energy distribution network, reliability and security thereof by: (a) guaranteeing transmission and distribution of electricity produced in high efficiency cogeneration; (b) ensuring priority or guaranteed access to electricity produced in high efficiency cogeneration, according to the regulations in force; and (c) priority distribution of electricity produced in high efficiency cogeneration, in safe conditions through operation of the national electric power system. In order to apply the provisions of this law, the Ministry of Energy acts through the Energy Efficiency Directorate, an organizational structure at the level of the central public authority, with responsibilities regarding the development and approval of policies and primary and secondary legislation in the field of energy efficiency at the level of final energy consumers. The Ministry of Public Works, Development and Administration collaborates with the Ministry of Energy, with technical and architectural universities in Romania, as well as research and design institutes, with a view to providing them with the data and information they hold in the field of energy efficiency. In order to identify non-household energy consumers, having the status of legal entities that have the obligation to report according to the law, licensed operators of electricity and natural gas distribution systems will transmit to the Energy Efficiency Directorate within the Ministry of Energy the consumption of economic operators, respectively public authorities and institutions, within the energy consumption contour of electricity and/or natural gas network operators. The Energy Efficiency Directorate within the Ministry of Energy monitors how information on energy efficiency, financial and legal mechanisms is transparent and widely and actively disseminated to all relevant market actors.
