Abstract
This Law primarily addresses the legal framework governing pig breeding holdings and the control of African swine fever (ASF). Its objectives include establishing rules for pig husbandry, biosecurity requirements, movement regulations, and disease management strategies, with the overarching goal of reducing the negative impacts of ASF on animal health, the economy, society, culture, and the environment. The Law operates within the context of European Union regulations, referencing specific EU legislation and emphasizing the importance of official controls, disease surveillance, and biosecurity measures. Key measures outlined include categorizing pig holdings (non-commercial, commercial, family-type, and others), implementing biosafety requirements tailored to each holding type, and establishing protocols for movement, identification, and registration of pigs. The Law mandates specific actions during disease outbreaks, such as the escalation and neutralization of dead or infected animals, with detailed procedures for wild boar management, hunting complex regulations, and kinetic fund operations. It emphasizes the importance of official veterinary checks, disease monitoring, and the role of various public authorities in disease control, including the Ministry of Agriculture, Veterinary and Food Safety Authority, and law enforcement agencies. Compensation mechanisms for affected farmers and stakeholders are also specified, along with penalties for non-compliance. Implementation is structured through institutional responsibilities assigned to multiple authorities, including the Ministry of Agriculture, Environment, Internal Affairs, and others, with defined timelines for the development of specific rules, guidelines, and research programs. The Law stipulates procedures for disease surveillance, stakeholder involvement through information campaigns, and enforcement measures, including fines and sanctions. It also details transitional provisions for registration, identification, and compliance, emphasizing procedural clarity and coordination among public institutions to ensure effective disease prevention, control, and biosecurity enforcement.
