This Law establishes the principles governing aquaculture activities and the commercialization of resulting products within Romania’s inland and marine waters. It identifies the National Agency for Fisheries and Aquaculture (ANPA) as the primary regulatory body responsible for the administration, control, and strategic organization of the sector.
The Law creates a system for the designation and protection of aquaculture zones. These zones are integrated into a national GIS-based spatial registry to ensure transparency and long-term land-use stability. Specific administrative procedures govern the registration of production units in the Unique Register of Aquaculture (ROUA), making such registration a mandatory prerequisite for legal operation and market access.
Provisions regarding state property focus on the management of fish-farming assets and the underlying land fund. The Law outlines the mechanisms for the privatization of state-owned companies and the processes for granting concessions or leases for hydraulic infrastructure. Current operators who own specialized assets are granted a preference right for land usage to ensure economic continuity and infrastructure maintenance.
Operational standards emphasize the health and security of aquatic populations and the surrounding environment. The Law prohibits the unauthorized introduction of non-native species and mandates the use of protective devices to prevent wild fish from entering farm water intakes. It classifies the unauthorized extraction of fish or water from a licensed facility as theft, providing a clear legal basis for the protection of private property and farm biosecurity.
The final sections of the Law establish a system of responsibilities and sanctions for non-compliance. Inspectors are authorized to verify production data, biosecurity protocols, and the maintenance of hydro-technical structures. Penalties vary according to the severity of the violation, with specific measures for the confiscation of equipment and products involved in illegal acts.
