Abstract
This Emergency Ordinance on fisheries regulates fishing activities and the exploitation of living aquatic resources in Romania. The ordinance establishes the general conditions for conducting activities in the fisheries sector and defines the responsibilities of the competent authorities in this field.
The Ordinance defines the main categories of activities and resources covered, including commercial fishing and recreational fishing. It sets out rules regarding the authorization, licensing, and monitoring of fishing activities, as well as conditions concerning the use of fishing equipment and gear.
The Ordinance includes measures aimed at the protection and conservation of living aquatic resources. It regulates closed fishing seasons, minimum catch sizes, and areas where fishing activities may be restricted or prohibited. These provisions are intended to support the sustainable management of aquatic resources and prevent overexploitation.
The Ordinance also establishes obligations for natural and legal persons engaged in fishing activities. It contains provisions regarding catch reporting, transportation and marketing of fishery products, and the responsibilities of institutions involved in supervision and control.In addition, it provides for administrative offences and applicable sanctions in cases of non-compliance with legal requirements. These include fines, administrative measures, and other penalties for unauthorized fishing activities, the use of prohibited equipment, or violations of rules concerning the protection of aquatic resources.
The Ordinance includes provisions on the management of fishing resources at both inland and marine levels, covering designated fishing zones, protected areas, and restricted waters. It also establishes rules for access to fishing grounds and conditions under which fishing activities may be limited in specific geographic areas to ensure resource sustainability. Finally, the Ordinance also addresses aspects related to scientific monitoring and assessment of fish stocks and aquatic ecosystems. It provides for data collection and evaluation activities carried out by competent authorities in order to support resource management decisions and to monitor the status of aquatic biodiversity.
