Abstract
This Order sets out in its Annex rules approved by the Minister of Agriculture and Rural Development. The text consists of 43 article divide into 2 Chapters. The first Chapter contains general provisions for commercial fishing and the second Chapter concerns commercial fishing in the Black Sea. the Order indicated in article 1 where commercial fishing and aquaculture is carried out (including inland waters). Commercial fishing in the Black Sea shall be carried out during the whole year with due observance of EU rules. Access to living resources in waters shall be granted by the National Agency for Fisheries and Aquaculture (ANPA). The Order sets out requirements and procedures for the granting of a fisheries licence and the establishment of professional fishermen's associations. A commission established and guided by ANPA shall decide on the assignment of fishing rights on specified criteria. This shall be done in line with Regulation (EC) No. 2371/2002. Forms of licences are set out in the Schedules to this Order. ANPA may withdraw or suspend licences pursuant to this Order. Fish caught during commercial fishing shall be landed at landing/mooring points or in first sale, as appropriate, where the complete landing declaration shall be submitted. The model for such declaration shall be set out in Annex 7. Landing points shall be designated on the basis of specified criteria by the President of ANPA. The Order sets out rules for handling and transportation of fish after landing.
As for fishing in the Black Sea, the Order regulates, among other things, small-scale fishing and monitoring and control of fisheries, and refers to Regulation (EC) No. 26/2004 and Council Regulation (EC) No. 2847/1993 establishing a control system applicable the Common Fisheries Policy.
