ORDER No. 807 for the approval of rules concerning access to living aquatic resources in the public domain of the state for the purpose of practicing commercial fishing in natural habitats with the exception of protected natural areas.

This Order of the Ministry of Agriculture and Rural Development approves the Rules on access to living aquatic resources in the public domain of the State for the purpose of commercial fishing in natural habitats, with the exception of protected natural areas. these rules are set out in the Annex. The Order refers to, among others, Council Regulation (EC) No 1224/2009 establishing a Community control system for ensuring compliance with the rules of the common fisheries policy and Regulation (EU) No 1380/2013 of the European Parliament and of the Council on the Common Fisheries Policy. Commercial fishing in natural habitats, with the exception of protected natural areas, shall be carried out annually from 1 January to 31 December, in compliance with the provisions of the European legislation and the national legislation in force.
The Rules concern, among other things, access to fisheries (to be granted by the National Agency for Fisheries and Aquaculture), criteria for the allocation of fishing rights, commercial fishing license for Black Sea fishing, inspection of fishing vessels, an authorization for manual harvesting of molluscs and crustaceans, discarding of fish, marking of fishing gear, designation of ports by ANPA and the landing of fish at such designated ports and landing centers, monitoring surveillance and control, acceptance of fish at centers of first-hand marketing of fish. Specific rules apply to fishing in the Black Sea and fishing for turbot.
