Abstract
This Law introduces systemic changes to electricity market operations, nuclear energy policy, and consumer rights. The Law formally permits the development and peaceful use of nuclear energy by repealing previous prohibitive legislation and establishing a preliminary administrative path for nuclear program assessment and safety management. It mandates a rigorous administrative process for any future nuclear developments, requiring detailed feasibility assessments, the establishment of robust safety and security protocols, and the management of radioactive waste in accordance with international standards.
The Law introduces the concepts of active customers and aggregators, allowing individual consumers and grouped entities to engage in production, storage, and the sale of electricity. This includes the ability to participate in electricity markets and provide balancing services to the grid, which were previously restricted to large-scale utility operators. Furthermore, it formally recognizes electricity storage as a distinct energy activity. It establishes a licensing regime for storage facilities, identifying them as critical infrastructure for maintaining grid frequency and stability amidst the increasing integration of intermittent energy sources.
For the end-user, the Law shifts the consumer landscape toward digitalization and transparency. It introduces dynamic price contracts, enabling consumers with advanced metering infrastructure to access electricity rates that fluctuate in accordance with real-time market conditions. To facilitate informed consumer choice, the Law mandates the implementation of an independent, publicly accessible platform for the comparison of supply offers. Additionally, it establishes a definitive transitional timeline for the financial models governing self-consumption. It designates December 31, 2026, as the final date for entry into the current compensation schemes, after which new participants will transition to a market-based billing structure.
Finally, the Law enhances the administrative rigor of the energy permitting process. It requires that all new energy facilities demonstrate explicit alignment with the Energy Development Strategy and the Integrated National Energy and Climate Plan.
