Abstract
This Regulation, in order to protect, control and preserve the genetic diversity, prescribes the detailed conditions that must be met by legal entities or entrepreneurs in terms of professional staff, technical equipment and facility space, here all relevant to the establishment of gene banks of genetic material of wild plants, animals and fungi. This text also determines the manner of operation of such gene banks, the manner of handling of biological material; and further sets out the necessary content of the application and list of relevant documentation that has to be submitted when requesting the license or authorization for establishing gene banks of wild plants, animals and fungi.
In order to grant the preservation of genetic diversity and correct handling of related genetic materials of wild plants, wild animals and wild or natural fungi, a gene bank may be established by a legal entity or an entrepreneur who: 1) is registered to perform activities in the field of research and experimental work in natural sciences and technological development in accordance with special regulations; 2) has its headquarter on the territory of the Republic of Serbia; 3) has a programme for the management of genetic material with projects for research, collection, preservation and use of such genetic material; 4) has at least two persons with the scientific title of Doctor of Science in full-time employment; 5) has the necessary laboratories; 6) has laboratory equipment, air conditioning chambers, internet communication and other means for realization of programs and realization of projects; 7) has professional and informative documentation. For the needs of the gene bank, research and storage of biological material, can be performed: In sity - means research and preservation of genetic material in an ecosystem or natural habitat and maintenance and restoration of a sustainable population of species in their natural environment; Ex situ - research and preservation of genetic material outside its natural habitat. The intake of biological material must not endanger the survival of ecosystems or the population of wild species of plants, animals and fungi in their habitats.
