Abstract
The Supreme Soviet decrees to validate the Regulation. The present Regulation determines the modalities of licensing of the use of subsoil for geological prospecting, extraction of minerals, construction and exploitation of underground constructions not related to the extraction minerals. The following types of activity are subject to compulsory licensing: regional geological and geophysical work, geological survey, engineering and geological prospecting, scientific research, setting up and conducting environmental monitoring, control over the regime of underground water without considerable damage to the integrity of subsoil. Committee on Geology (GEOLCOM) and its territorial branches are authorized to issue licenses for carrying out the aforesaid activity while the terms of license must be coordinated with the bodies of local self-government. The Act consists of 19 Sections. Section 1 lays down the general provisions. Section 2 regards state system of licensing of the use of subsoil. Section 3 concerns the plots of subsoil conceded in use. Section 4 regards concession of the plots of land. Section 5 deals with the system of payment for the use of subsoil. Section 6 specifies the types of licenses. Section 7 establishes the duration of licenses. Section 8 specifies the contents of licenses. Section 9 regards holders of license. Section 10 establishes the system of selection of candidates for concession of license. Section 11 determines mechanism of issuing licenses. Section 12 determines the particulars of licensing of the use of continental shelf and Exclusive Economic Zone of the Russian Federation. Section 13 determines the modalities of the use of subsoil in particular cases. Section 14 determines the modalities of the use of subsoil for the purpose of extraction of underground water and disposal of hazardous substances, waste residues of the disposal of effluent water in subsoil. Section 15 establishes the grounds for the cessation of the right to the use of subsoil. Section 16 establishes the main rights and duties of the holders of license. Section 17 determines conditions for invalidation of licenses. Section 18 establishes control over the observance of the conditions of the use of subsoil determined in license. Section 19 regards issuing of licenses to the enterprises who had been using subsoil before the enactment of the present Regulation.
