Decree of State Council No.2459 of 2003 on validation of the Regulation on the modalities of obtaining the right of use of the plots of subsoil containing deposits of generally used minerals or of the plots of land of local importance to be used for purposes not connected with the extraction of minerals.

President of State Council decrees to validate the Regulation. The use of the plots of subsoil containing deposits of generally used minerals or of the plots of land of local importance to be used for purposes not connected with the extraction of minerals must be carried out exclusively on the basis of the licence on the use of subsoil issued and registered by the Ministry of Ecology and Natural Resources of the Republic of Tatarstan. The document consists of 14 Sections and contains 2 Annexes. Sec.1 lays down general provisions. Section 2 establishes the system of licensing. Section 3 classifies the users of subsoil. Sec.4 determines the plots of subsoil that can be conceded in use. Section 5 classifies the plots of land. Section 6 determines the types of licences and their contents. Section 7 establishes the system of the selection of candidates for obtaining licence. Section 8 determines the mechanism of concession of licence. Sec 9 determines the rights and the duties of the holders of licence. Section 10 gives the grounds for restriction, suspension or cancellation of the right of the use of subsoil. Section 11 determines the conditions for invalidation of licences. Section 12 regards control over the fulfilment of conditions of the use of subsoil. Section 13 regards payment for the use of subsoil. Section 14 establishes liability for the infringement of the legislation on subsoil. Annex 1 contains application form for obtaining licence for the use of subsoil. Annex 2 contains the list of documents that must be attached to the application form.
