Abstract
Technical regulations are adopted for the following purposes: (a) protecting the life or health of citizens, the property of individuals or legal entities, state or municipal property; (b) protecting the environment, the life or health of animals and plants; (c) preventing actions that mislead purchasers, including consumers; and (d) ensuring energy efficiency and resource conservation. Adoption of technical regulations for other purposes is not permitted. Technical regulations, taking into account the degree of risk of causing harm, establish the minimum necessary requirements that ensure: (a) radiation safety; (b) biological safety; (c) explosion safety; (d) mechanical safety; (e) fire safety; (f) product safety (technical devices used at a hazardous production facility); (g) thermal safety; (h) chemical safety; (i) electrical safety; (j) radiation safety of the population; (k) electromagnetic compatibility in terms of ensuring the safe operation of devices and equipment; and (l) unity of measurements. The adoption of technical regulations for other purposes is not permitted. This Federal Law primarily addresses the framework for technical regulation. Its stated objectives include ensuring compliance with national economic interests, aligning with international standards, and facilitating the safety and quality of products and services. The legal principles outlined emphasize the necessity of technical regulations that do not impede entrepreneurial activity more than is minimally required to achieve safety and compliance goals. The document specifies several key measures, including the requirement for federal executive authorities to publish technical regulations and standards at least thirty days prior to their approval. It mandates the preparation of expert conclusions regarding the feasibility of adopting technical regulations within thirty days of submission. Additionally, it outlines the process for registering standards and the need for compliance with both national and international standards, emphasizing voluntary adherence to certain recommendations. Implementation mechanisms include the establishment of expert commissions to evaluate technical regulations and the requirement for public discussions prior to finalizing regulations. The document stipulates that projects for regulatory changes must be published in an accessible electronic format at least sixty days before adoption. It also highlights the involvement of various stakeholders, including scientific organizations and public associations, in the regulatory process, ensuring a collaborative approach to technical regulation.
