Federal Law No. 428-FZ "On bioresource centers and biological (bioresource) collections and on amendments to Article 29 of the Federal Law "On Wildlife".

This Federal Law focuses on the establishment and regulation of biobanks and biological collections in Russia. Its primary objective is to ensure the sustainable and rational use of genetic resources within scientific and technological activities. It addresses the growing need for a structured approach to managing genetic resources, reflecting a broader commitment to biodiversity conservation and the responsible use of biological materials in research and development. The implementation plan outlined in the law includes the creation of an Interagency Commission tasked with overseeing the formation, preservation, and utilization of genetic resource collections. Additionally, it establishes a Fund for Biological Collections and national centers dedicated to genetic resources, along with national catalogs of particularly valuable genetic samples. The law sets forth specific requirements for biological collections, ensuring that they are maintained in accordance with established standards. This legal framework is crucial for fostering innovation in agriculture while ensuring the conservation of genetic diversity, which is vital for adapting to changing environmental conditions and meeting future food demands. Article 29 of the Federal Law of the Russian Federation on Wildlife (No. 52-FZ of 1995) shall be amended to add the following wording: “Zoological collections included in the Fund of Biological (Bioresource) Collections of the Russian Federation are subject to state registration in accordance with the legislation of the Russian Federation on bioresource centers and biological (bioresource) collections”. This Federal Law contains 11 Chapters divided into 32 Articles. Chapter 1 lays down general provisions. Chapter 2 sets up Fund for Biological (Bioresource) Collections. Chapter 3 specifies objectives of creation and requirements for creation, formation, preservation, development, study and use of biological (bioresource) collections in the Russian Federation. Chapter 4 regards bioresource centers. Chapter 5 regards information support for the creation, formation, preservation, development, study and use of biological (bioresource) collections, organization of the activity of bioresource centers. Chapter 6 regards ensuring safety of the creation, formation, preservation, development, study and use of biological (bioresource) collections. Chapter 7 establishes financial support for activities related to the creation, formation, preservation, development, study and use of biological (bioresource) collections. Chapter 8 deals with importation into the territory of the Russian Federation and exportation outside the territory of the Russian Federation of samples of biological (bioresource) collections, storage units and materials of samples of a biological (bioresource) collection. Chapter 9 establishes liability for violation of the Russian legislation regulating relations in the field of biological (bioresource) collections. Chapter 10 amends Federal Law of the Russian Federation on Wildlife (No. 52-FZ of 1995). Chapter 11 lays down conclusive provisions.
