Abstract
The Federal Law consists of XIV Chapters that contain 79 articles. Article 5 establishes that the property that can be object of mortgage includes plots of land, except for public or municipal land, agricultural land that makes part of stock of land belonging to agricultural organizations, peasant farms and personal plots of land used for subsidiary small-holding in accordance with the present Federal Law. It is prohibited to mortgage a part of the plot of land is smaller that minimum size ceiling established by the regional normative acts and normative acts of the local administration currently in force for the plots of land for various purposes. Article 13 specifies that drawing up and issuing of mortgage certificate is not permitted for the plots of land that make part of agricultural land as established by this Federal Law and for forest. Paragraph 1 of article 62 establishes that according to mortgage contract the plots of land considered private property of physical persons, associations, juridical persons conceded for gardening, stock-breeding, individual housing, country-cottage and garage construction, plots of land that make part of personal subsidiary small-holding and plots of land on which are situated buildings, edifices and constructions to the extent indispensable for their normal functioning. In case of share-holding or collective property on the plots of land specified in the paragraph 1 of the Article 62 mortgage can be done only for the plots of land belonging to physical or juridical person that must be singled out from the stock of land owned on conditions of common share-holding or collective property.
