Abstract
This Government Resolution defines the procedure for establishing fisheries reserve zones, changing their boundaries, and making decisions on terminating the existence of fisheries reserve zones. The establishment of fisheries reserve zones is aimed at preserving aquatic biological resources, including preserving the conditions for their reproduction, and creating conditions for the development of aquaculture (fishfarming) and fisheries. Fisheries reserve zones are established for an indefinite period. When determining the boundaries of a fisheries reserve zone, the following shall be taken into account: (a) data from state monitoring of aquatic biological resources indicating the need to establish a fisheries reserve zone; (b) the significance of particularly valuable and valuable species of aquatic biological resources, for the purpose of preserving which a fisheries reserve zone is established, for the development of aquaculture (fishfarming) and fisheries, as well as their biological characteristics; and (c) the presence of negative factors associated with the implementation of economic or other activities that impact the state of aquatic biological resources and their habitat up to the loss of their commercial value. The size (area) of a fisheries conservation zone and its boundaries shall be determined taking into account the length and (or) area of the water area of a waterbody of fisheries importance or a part thereof and the size of the territory adjacent to the waterbody or part thereof. Fisheries conservation zones shall not be established within the boundaries of: (a) protected areas of federal and regional significance; (b) areas used in the interests of the defense of the Russian Federation, and approaches to them; (c) marine areas where navigational and hydrographic facilities provide for the safety of navigation, including their protection zones; (d) seaports, established vessel traffic routes, including fairways and sea channels, sea corridors and traffic separation schemes in the territorial sea, contiguous zone and exclusive economic zone of the Russian Federation; (d) areas of bottom soil disposal; (e) sea areas with special navigation conditions, including areas prohibited and temporarily dangerous for navigation, in which navigation, anchoring, dredging, blasting and other underwater operations, overflight, hovering, landing (water landing) of aircraft and other activities are completely or temporarily restricted; and (g) sea restricted areas and former mine-hazardous areas, as well as areas of sunken explosives.
