Abstract
This Ministerial Decree implements the Montreal Protocol on Substances That Deplete the Ozone Layer. The Prime Minister decrees to to establish that import-export of ozone depleting substances and produce containing them must be carried out in accordance with licenses issued by the Ministry of External Economic Ties and Trade in conformity with the present Regulation. The present Regulation is applicable to all legal persons irrespectively of their organizational and legal form and to all individual entrepreneurs engaged in activity related to ozone depleting substances and produce containing them, except for cases envisaged by the Russian legislation and international agreements. Import-export, and transit through the territory of the Russian Federation into or from the states that are not Parties of the Montreal Protocol of ozone depleting substances specified in Annex 1 are prohibited. Import-export into or from the states that are not Parties of the Montreal Protocol of ozone depleting substances specified in Annex 2 are prohibited. The present Regulation is not applicable to transit through the territory of the Russian Federation of ozone depleting substances specified in Annex 2. State Committee for Environmental Protection is authorized institution entitled with the task of decision-making as regards the possibility of import into the Russian Federation and export from the Russian Federation of ozone depleting substances and produce containing them. In case of the infringement of the present Regulation legal persons, individual entrepreneurs and officials are liable to prosecution in accordance with the Russian legislation.
