Abstract
Fisheries Regulation for the Northern fishing basin regulates the activities of Russian legal entities, individual entrepreneurs and citizens, including persons belonging to the indigenous small-numbered peoples of the North, Siberia and the Far East of the Russian Federation and their communities engaged in fishing in internal waters of the Russian Federation, including internal sea, territorial sea, continental shelf and exclusive economic zone of the Russian Federation within the Northern fishery basin, with the exception of waterbodies or their parts, located in protected natural areas of the federal significance within which fishing is prohibited in accordance with the legislation of the Russian Federation on protected areas of federal significance, as well as foreign legal entities and citizens engaged in fishing in accordance with the legislation of the Russian Federation and international treaties of the Russian Federation in the indicated areas. Fisheries Regulation regulate the extraction (catch) of aquatic biological resources for the purpose of commercial fishing, coastal fishing, fishing for research and control purposes, fishing for educational and cultural purposes, fishing for aquaculture (fish farming) and recreational fishing. The Northern fishing basin includes fishing area for catch of aquatic biological resources of Barents Sea with river basins flowing into it, the area of regulation of the Mixed Russian-Norwegian Fisheries Commission 1, including Barents, Norwegian and Greenland Seas and adjacent areas of the Arctic ocean, White Sea with basins of rivers flowing into it, Lake Onega with basins of rivers flowing into it, as well as fishery waterbodies located in the territories of the Republic of Karelia (with the exception of Lake Ladoga with the basins of rivers flowing into it), the Komi Republic, Nenets Autonomous Area, Arkhangelsk, Murmansk, Vologda (excluding fishery waterbodies located on the territory Cherepovets district) and Kirov regions, limited by the basins of the aforesaid rivers. Fisheries Regulation establishes: (a) types of authorized fishing; (b) rates, including rates of yield of products of processing of aquatic biological resources, including caviar, as well as the parameters and terms of the authorized fishing; (c) restrictions on fishing and other activities related to management of aquatic biological resources, including: prohibition of fishing in certain areas and for certain species of aquatic biological resources; ban on fishing in certain areas and in relation to certain species of aquatic biological resources; minimum size and weight of harvest (catch) aquatic biological resources; types and number of authorized fishing gear and fishing methods; mesh size of fishing gear; distribution of fishing areas (area, subarea, fishing zone, fishing subzone) between groups of vessels, differing in fishing gear, types and sizes; periods of harvest (catch) of aquatic biological resources for groups of vessels, differing in fishing gear, types (power) and dimensions; number and types (capacity) of fishing vessels that can carry industrial fishing and coastal fishing at the same time in one fishing area; minimum volume of harvest (catch) of aquatic biological resources per vessel; time at sea of vessels for commercial fishing and coastal fisheries; authorized by-catch of certain species in the course of harvest (catch) of other species of aquatic biological resources; periods of fishing in waterbodies of fishery significance; (d) requirements for conservation of aquatic biological resources, including responsibilities of legal entities, individual entrepreneurs and citizens, performing fishing, requirements for legal entities, individual entrepreneurs and citizens engaged in fishing, as well as to the documentation required for fishing; and (e) the amount authorized to a citizen for extraction (catch), specified amount and weight, of aquatic biological resources not related to protected species inserted in the Red Book of the Russian Federation, in the process of recreational fishing.
