Abstract
The Minister orders to validate the Instructions. Structural bodies of the central office of the Ministry and its territorial agencies must adopt for guidance and application the aforesaid Regulation. The present Instructions regulate the activity of the bodies of the Ministry of Natural Resources as regards the organization and carrying out state control over the use and protection of land. Territorial agencies of the Ministry in addition to the present Instructions can validate the necessary instructive and methodical documents and give clarifications as regards carrying out state control over the use and protection of land taking into account the peculiarities of legal and normative acts of the subjects of the Russian Federation. The document consists of 12 Sections and contains 17 Annexes. Section 1 lays down the general provisions. Section 2 establishes the rights and the duties of the officials carrying out state control. Section 3 regards the organization of state control over the use and protection of land. Section 4 regards legalization of the documentation in case of exposure of the infringements of land legislation. Section 5 deals with examination of cases of the infringement of land legislation. Section 6 establishes the modalities of appeal against administrative sanction for the infringement of land legislation. Section 7 concerns execution of sanctions regarding imposition of fine. Section 8 establishes the modalities of forwarding materials regarding the decision-making about penal prosecution or disciplinary liability of the infringers of land legislation. Section 9 establishes the modalities of appeal against illegitimate decisions regarding expropriation and concession of the plots of land. Section 10 establishes the modalities of reimbursement of damages caused by the infringement of land legislation. Section 11 establishes the modalities of forwarding materials regarding the infringement of land legislation to courts and arbitration tribunals. Section 12 regards record keeping and drawing up reports regarding carrying out state control over the use and protection of land.
