Presidential Decree No. 233 “On some issues of the organization of the activities of the Presidium of the Council subordinated to the President of the Russian Federation to counteract corruption.”

This Presidential Decree establishes the procedure for examination by the Presidium of the Council subordinated to the President of the Russian Federation to counteract corruption of the following issues: (a) issues related to the compliance with the requirements related to official conduct of persons occupying state positions in public offices of the Russian Federation; and (b) application of a citizen who held a public office of the Russian Federation or a federal civil service position giving consent to hold a position in a commercial or non-profit organization and (or) to perform in such an organization work (provision of services to such organization) on the terms of a civil law contract in cases stipulated by federal laws, if certain functions of the state management functions of such organization were part of his official (service) duties, until the expiration of two years from the date of dismissal from public office or dismissal from public service. Presidium can make one of the following decisions: (a) to establish that the case in question shows no evidence of a violation by a person holding a public office of the Russian Federation or a federal civil service position of the requirements of official (service) conduct; and (b) to establish that in the case under review there are indications of a violation by a person holding a public office of the Russian Federation or a federal civil service position has violated the requirements of official (service) conduct. In this case the Presidium shall prepare a report to the President of the Russian Federation or the Chairman of the Government of the Russian Federation and, if necessary, notifies the head of the federal government agency in which the person is serving.
