Abstract
The law is designed to regulate the conservation and protection of biological diversity, wildlife species, and protected areas. The law categorizes wildlife species and governs the establishment and management of conservation areas, national parks, and nature reserves. It prohibits certain activities in protected areas and establishes the organs responsible for biodiversity management, such as the Authority for Biological Diversity Conservation and the Science Advisory Committee. Provisions include the protection of biological diversity, permits for accessing genetic resources, benefit-sharing, and controlling invasive species.
Chapter V of the law addresses the coexistence between humans and wildlife, focusing on mutual coexistence, collaboration between the Authority and stakeholders, and managing problematic or feral animals. It includes provisions for compensation for damages caused by wildlife and the management of vermin. Chapter VI establishes the rights of ownership over wildlife, state trophies, trade in species specimens, and wildlife user rights, including the transfer and revocation of these rights. It also covers appeals, control of commercial activities, transportation of specimens, and regulations on specimens bred in captivity or artificially propagated, as well as those in transit or transshipment.
Chapter VII outlines administrative faults and sanctions, including violations related to access to genetic resources, degrading protected areas, trespassing, and grazing domestic animals in protected areas. Chapter VIII focuses on offences and penalties, addressing crimes against wildlife, such as poaching, illegal possession or trade of wild animals and plants, destroying habitats, and biopiracy. It also covers offences in protected areas, including arson, mining, cultivating, and polluting. The law consists of 87 Articles divided into 9 Chapters.
